Ande Tech Service Contract Agreement

  1. GENERAL
    1. We have two different contracts referred to on invoices as follows: (Please circle the contract you wish to have.)
      1. "Small Business Contract" $60/hour
        12 month commitment, 4 hours per month minimum charge. ($240.00/m)
      2. "Corporate Contract" $45/hour
        12 month commitment, 16 hours per month minimum charge. ($720.00/m)
    2. This contract does not change the terms or conditions of any previously signed contract.
    3. No changes in these conditions shall be valid unless in writing and signed by both parties.
    4. The term of this contract is for a period of one(1) year from the date the customer signed below.

     

  2. DEFINITIONS - In these conditions the following terms shall mean:
    1. Ande Tech: Ande Tech Computer Repair
    2. Customer: The person, firm or organization placing a request for services with Ande Tech.
    3. Tech: The technician employed by Ande Tech.
    4. Main office: Ande Tech owner or secretary. The main office phone number is (757) 271-6668.
    5. Service(s): Any computer related work provided by Ande Tech. This includes, but is not limited to, desktop and laptop computer hardware or software troubleshooting,  repairing or upgrading; website publishing; computer programming; graphics design; and personalized computer training.

     

  3. CHARGES AND PAYMENT
    1. Rates as of the signing of this contract are as follows.
      1. "Small Business Contract" $60/hour
        12 month commitment, at a minimum monthly payment of $240.00 which pays for 4 hours.
      2. "Corporate Contract" $45/hour
        12 month commitment, at a minimum monthly payment of $720.00 which pays for 16 hours.
    2. Payment for each month must be received before services are rendered for that month. If you choose not to use our services for that month you are still required to pay the minimum.
    3. Payment shall be made either in cash, by check, or by credit card.
    4. Checks shall be made payable to "Ande Tech Computer Repair".

    6. Payment will not be made directly to the tech unless authorized by Ande Tech main office.

    7. The customer will be charged a $35 fee for any returned checks.

       

  4. RESPONSIBILITIES
    1. Ande Tech:
      1. Will treat all confidential customer data as confidential. And will not share nor use any customer confidential information in anyway contrary to the customers wishes.
      2. The tech will state and log the start and end time of the service call with the customer.
        1. This statement may be done verbally in person or by phone.
        2. Example #1: At 2:15 P.M., the customer calls in for help. He explains the problem to the tech. The tech determines that this can be resolved over the phone. At that point the tech informs the customer that the service call is starting now at 2:20 P.M. The problem is resolved at 3:00 P.M. The tech informs the customer that their time stops at 3:00 P.M. The customer has used up 40 minutes of their service time.
        3. Example #2: At 2:15 P.M., the customer calls in for help. He explains the problem to the tech. The tech determines that this problem requires a visit to the customer's location. They agree on Friday at 10 AM as an appointment to begin the service call. Friday morning at 9:30 the tech knows it will take 30 minutes to arrive at the customer's location. He calls ahead to verify the appointment and also state that he is on his way. The tech also states the start time and logs it in his record. The service call is finished at 10:30AM. The customer has used up 1 hour of their service time.
      3. Travel time to the job will be kept to a minimum in order to save the customer money.
        1. In other words: the tech will not take the long way road to make more money.
        2. If the customer has any dispute about the tech's travel time, the customer should call the main office to discuss it. Do not concern the tech with that matter. The main office will work out a reasonable adjustment.
        3. If a service call can be better done over the phone or by remote computer control then the tech may select to do so in order to save the customer time and money.
      4. Will assign a tech that is knowledgeable in the area that is required.
        1. This might not always be the same tech.
        2. An apprentice tech may be assisting the assigned tech. In this case the customer is only charged for the time of the assigned tech. This is only for training purposes of the apprentice. This should not become a hindrance to the assigned tech, but rather a help.
        3. In some cases the customer may need more than one tech for a service call. In this case the time will be added for each tech needed. For example: A customer has an office with 20 desktop computers that need to be upgraded from Windows 98 to Windows XP. We have only one day to get it done. Ande Tech sends 3 techs to complete the job more efficiently. If the job takes 7 hours for the 3 techs to complete, then the customer is charged 21 man-hours.
      5. Will contact the customer each month to see what they want the tech to do for them and to set any appointment needed.
      6. Will attempt to backup data stored in My Document folders on computers that may be at risk for loosing data. Depending on the circumstances this backup may not be possible, such as Hard Drive failure. If the customer does not want this backup to be done they must specify that in writing. The reason for this is that once the data is gone it cannot be retrieved.
      7. Ande Tech is service only, and therefore does not make money selling parts or materials.
        1. Ande Tech is willing to purchase parts or materials on behalf of the customer.
        2. Ande Tech does not warrantee such parts or materials.
        3. Any items that Ande Tech purchases for the customer will be charged to the customer at cost plus a $20 Gofer Fee for getting the parts.
        4. Ande Tech only makes money in the time taken to conduct the purchase.
          1. Example #1: The tech determines the customer's computer has a dead modem. The customer does not want to personally go to a nearby store such as Best Buy to purchase it. Therefore he sends the tech in his place. The tech gives the receipt to the customer. Best Buy carries the warrantee on this new modem.
          2. Example #2: Customer wants Ande Tech to custom build a computer system. Ande Tech will work with the customer to determine what parts are needed, then arrange for the purchase. Either the customer will prepay Ande Tech for the parts or pay the distributor directly. Once the tech has the parts, he will build the system, deliver it and set it up.
    2. Customer:
      1. Must provide access to equipment to be serviced if applicable.
      2. Will pay the minimum monthly service charge even if services are not needed for that month. Those hours maybe rolled over into the next month. For example: The customer's business closes for vacation in the month of July. Since they are paying for a minimum of 4 hours of service for July and there is no need for computer help that month, those 4 hours may be used in August, giving them 8 hours of service. They may use this for an all day computer training class for their staff.
      3. Must inform Ande Tech of any change in service call appointments, such as a cancellation or a postponement. If the tech arrives at the service location and the service call is cancelled or postponed then the customer is still charged for the travel time.
      4. On any computer that is at risk of loosing data or for any other reason needs to be backed up, it is the customer's responsibility to save all files that they want to keep into their My Documents folder. For example: On my own computer, my emails can be exported from Microsoft Outlook into C:\Documents and Settings\Bj\My Documents\backup.pst.
      5. Because of the many different services Ande Tech provides, the customer is not locked in to one service. The customer can choose to have one of our Web techs to work on their website or one of our instructors to teach a staff member how to use a certain program on their computer. It is the customer's choice in how they want to use Ande Tech resources.

       

This Agreement between the authorized representatives of the Customer and Ande Tech is made.
